Woman’s Injury Claim Thrown Out After Christmas Tree Toss

A woman who sued an insurance company for £650,000 after a car crash has lost her case after a judge saw a photo of her tossing a christmas tree at a charity event.

Claimed she was unable to work or play with her children

Kamila Grabska claimed she suffered from chronic back and neck pain after a collision in 2017. She said she was unable to work as a cleaner or play with her children due to her “disabling” condition.

She sued the insurance company of the driver who hit her car, seeking compensation for the loss of past and future earnings, as well as medical expenses and general damages.

However, her claim was dismissed by an Irish court after the defence produced a photo of her throwing a Christmas tree at a festive fundraiser in 2018.

The photo, which was published in a local newspaper, showed Grabska lifting and tossing a 5ft spruce as part of a competition. The judge said the photo was “graphic” and “completely at odds” with her claims of being in constant pain.

Video showed her training her dog for over an hour

The defence also presented a video of Grabska training her dog in a park for more than an hour. The video showed her bending, stretching, and running with her pet.

The judge said the video contradicted her testimony that she could not sit or stand for more than 15 minutes, or walk more than 200 metres.

Judge ruled that her behaviour was inconsistent with her claims

The judge ruled that Grabska’s behaviour was inconsistent with her claims of having a “disabling” condition. He said he did not find her evidence credible or reliable, and that she had exaggerated her symptoms.

He dismissed her claim and ordered her to pay the legal costs of the defence.
